12 straipsnis Informacijos perdavimas ir duomenų apsauga 1. Visa informacija, kurią gauna muitinė vykdydama savo funkcijas ir kuri pagal savo turinį arba pateikimo būdą yra konfidenciali, laikoma profesine paslaptimi. Kompetentingos valdžios institucijos be aiškaus tą informaciją pateikusio asmens arba valdžios institucijos leidimo jos neatskleidžia, išskyrus 47 straipsnio 2 dalyje numatytus atvejus. Vis dėlto ši informacija gali būti atskleista be leidimo, jeigu muitinė privalo arba yra įgaliota ją atskleisti pagal galiojančias nuostatas, ypač susijusias su duomenų apsauga, arba kai atliekami procesiniai veiksmai. 2. 1 dalyje nurodyta konfidenciali informacija gali būti perduodama Sąjungos muitų teritorijai nepriklausančių šalių ar teritorijų muitinėms ir kitoms kompetentingoms valdžios institucijoms muitinių bendradarbiavimo su tomis šalimis ar teritorijomis tikslu pagal tarptautinį susitarimą arba pagal bendrosios prekybos politikos srities Sąjungos teisės aktus. 3. Atskleidžiant arba perduodant informaciją, kaip nurodyta 1 ir 2 dalyse, užtikrinamas tinkamas duomenų apsaugos lygis griežtai laikantis galiojančių duomenų apsaugos nuostatų.
